How to Succeed as an Expert Witness by Looking at Each Case from the Other Expert’s Perspective

If you take cases for both plaintiffs and defense, then you must understand both perspectives so you can undertake your part well for either side. It will help, as well, if you can anticipate what the other side’s expert is likely to do. You know he or she is going to look closely at your report, so you have to be doubly careful about what you write. Think about the basis for each opinion you will express.
Regardless of whether you are acting as an expert witness for the plaintiff or for the defense, your goal is to assess whether each of the steps taken by the other side’s expert made sense. Was it proper, necessary, and complete enough to lead to the stated opinion? Assess whether any portion of the expert’s logic suffered from mistaken assumption or oversight. If so, your attorney can then legitimately use your assessments to undermine the credibility of the expert or the opinion.
More than one possibility often exists. A common error made by people in general is to take the easy way out and say: “that was the only way possible.” Bridge players may say there was no other way to play the cards. Backgammon players may say there was no other way to play the dice. Expert witnesses may say that their opinion is the only sensible one. Don’t assume that the way taken is the only way; look for other possibilities, and explore them.
If you are the plaintiff’s expert, Think About all the possibilities. Prepare to explain why you may have chosen one or only a subset of the possibilities as the basis for your opinion.
If you are the defendant’s expert, list other possibilities that the plaintiff’s expert should have considered, and why.
Pointing out other possibilities may be enough to generate reasonable doubt or to undermine the credibility of the other side’s expert.

Law Offices of Heath D. Harte Comments on Recent Article about Ex-Convicts Who Profit from their Criminal Activity by Booking Speaking Engagements

Heath D. Harte, an attorney-at-law with over twenty-five years of experience practicing in Connecticut and New York, released a statement today commenting on a recent article that highlights the increase in ex-convicts who are receiving payment for lectures and appearances to teach lawyers and other professionals about their experiences.

The recent ABAJournal article* highlights the example of former Enron CFO, Andrew Fastow, who pled guilty to conspiracy to commit wire and securities fraud in 2004. Last year, Fastow spoke to the Association of Certified Fraud Examiners. The article also mentions other white-collar convicted criminals who have financially benefitted from speaking engagements, including Scott London (formerly of KPMG, convicted of insider trading), and Humberto Aguilar (a former attorney who went to prison for money laundering). London and Aguilar have had numerous speaking engagements and appearances. Although the ACFE does not make direct payments to ex-cons, the article explains that the speakers can still profit from the increased visibility. Augilar, for example, said he often books appearances that earn $ 5,000-6,000 per appearance as an expert witness and a consultant on how to prevent these crimes.

Heath D. Harte believes this trend in profiting off of having a criminal past is wrong, and that changes should be made so that ex-cons do not continue to profit from their crimes. “White collar crime should NOT pay,” he states. “Being convicted of fraud appears to open many doors to lucrative speaking engagements. If murderers cannot receive payment or profit for their story, similar legislation should be applied to other ex-convicts that are profiting from their illegal activities.”

The Expert Witness Consulting Services industry recovered strongly from the recession over the past five years. Despite strong growth prior to the economic downturn from robust corporate and legal activity, industry demand and revenue fell during the recession. A decline in per capita disposable income and corporate profit caused businesses and customers to have fewer funds available for expert witness consulting services; consequently, the industry’s growth slowed in 2009. Since 2010, industry demand and revenue have increased as corporate profit and per capita disposable income strengthened as well. Overall, IBISWorld expects industry revenue to increase at annualized rate in the five years to 2014, as the industry recover from recession lows. Revenue is estimated to increase due to greater demand from law firms and government organizations.

According to IBISWorld Industry Analyst David Yang, “Competition has increased throughout the past five years, which has pressured revenue growth and industry profit.” Although firms in the industry compete against one another on the basis of price, quality of service, expertise, communication skills and reputation, the industry as a whole faces significant external competition as well. In particular, integrated management consulting firms and large accounting firms that provide comprehensive strategy, economic and management consulting services pose as competition to expert witness consulting services. External competition also comes from firms that have a general counsel or in-house legal team with expert witnesses. Nevertheless, industry profitability is expected to increase in the five years to 2014, due to the recovery from recession lows.

During the five years to 2019, IBISWorld projects industry revenue to increase at an average annually. “Expert witness consultants will benefit largely from strengthened demand from law firms, higher corporate profit, a larger number of civil cases and greater per capita disposable income,” says Yang. For instance, corporate profit is expected to grow at an average annual rate in the five years to 2019. With this, potential customers will have more money available for the industry’s high-cost services. In the next five years, companies are expected to provide more value-added services and employ workers with specialized backgrounds, and as a result, firms will be able to offer more services to clients and compete more effectively in the industry.
